The most important information about building a house for a 70 m2 application
Currently, any adult person who has a building plot can - using a simplified procedure - build a single-family house on it with a maximum building area of 70 m 2 . However, the investment must serve to meet your own housing needs. To build a house for a 70 m 2 notification, you do not have to hire a construction manager or even keep a construction log. In the absence of a local spatial development plan, it is enough to apply to the commune for a document on the development conditions, which you will receive within a maximum of 21 days from the date of submitting the application in this matter. Importantly, the architectural and construction administration body has no right to object to the notification you have made, and you can start construction immediately after receiving the construction notification and notifying the district construction supervision inspector of the date of commencement of construction works.
How to build a house for a 70 m2 application? Regulations 2025
The rules of the “House without formalities” program have not changed in 2025. To build a house under the program, it is necessary to report the construction to the district staroste . You must attach the following to the report:
- construction project,
- plot or area development plan,
- architectural and construction design along with opinions, agreements, permits and other documents,
- a declaration of the right to use the building plot,
- a decision on the conditions of development and land management (if required);
- declarations – that the construction will be carried out for your own residential needs, that you will take over responsibility for managing the construction (if you decide not to appoint a construction manager) and that the attached documentation is complete.
You can send these documents by post, bring them to the office in person or submit them through a proxy or submit them online via the website. Then you notify the construction supervision authority about the planned date of commencement of construction works. Done. Now you can start building your house based on the notification.
The program rules that raise the most doubts
There is a lot of false information in circulation about the "House Without Formalities" program. So we checked the current rules at the source! Perhaps the most common myth is that a house built using the simplified procedure cannot be sold or rented in the future. Meanwhile, the act says nothing about the potential sale of such a property. However, when submitting a notification, you must meet the condition of conducting construction in order to meet your own housing needs. You submit such a declaration "at the start" under penalty of legal liability. This means that you cannot build a house with the intention of selling or renting it, but in the future, at any time, you have the right to sell or rent it.
The second, often heard myth concerns the lack of possibility of inspection of a house up to 70 m2 by the building supervision authority . Although the starosta does not have the right to object to the notification of construction of a house up to 70 m2 , the building supervision authority can certainly check whether the building is being built/was built in accordance with the provisions of the building law and spatial order. In the event of finding any irregularities, appropriate legal actions will be taken.
House for registration 70 m2 - planned changes in regulations
After 3 years since the introduction of the program, it turns out that the simplified procedure for building single-family houses has some significant flaws, which the government wants to address. The planned changes to the law concern, among others, the possibility of verifying documents and filing an objection by the district governor if the notification turns out to be defective. However, legislative work is progressing very slowly... Experts believe that the most attractive legal change for investors would be to allow the construction of houses with a building area larger than 70 m 2 without a permit. Although the usable area of such a building can even exceed 100 m 2 , it is still a bit too little for the needs and preferences of many modern 2+2 and larger families.
