The procedure of obtaining a building permit is a mandatory step before most construction works begin. In order to obtain a decision on a building permit, you must fill out an appropriate application and submit it along with numerous documents. The decision is issued by the district governor or the president of a city with district rights. This process probably does not arouse much fear among developers. However, it is a nightmare for private investors who dream of owning a small single-family home and are simply terrified and overwhelmed by the complicated formalities.

Although Polish construction law is changing dynamically and according to the government's announcements, the coming years are to bring even more facilities for investors, one still has to wait for a house without a permit of 100 m2 . How long? It is not known.

The good news is that in 2025 you will be able to build a house without a building permit, but unfortunately with a smaller building area.

House without a permit 2025 – not 100 m2, but 70 m2

Current legal regulations allow a private person to build a single-family house for their own needs without a permit, with a building area of up to 70 m 2 , with a maximum of two storeys. This is the main assumption of the government program "House without formalities", which has been operating for 3 years. This program was created to revive single-family construction. It introduced simplifications in procedures and accelerated the construction of houses. The assumptions of the program have not changed since 2022, so a house without a permit 100 m 2   still remains in the realm of investors' dreams and the plans of those in power.

For some investors, building a 70-meter house seems pointless, so they decide to take up a formal fight for a building permit. On the other hand, as the Ministry of Development and Technology emphasizes, there can be over 100 m 2 of usable area on two floors! For many people, including families with children, such a house will be completely sufficient. House without a permit 70 m2 – what conditions must be met?

Under current law, you can build a house without a permit:

  •         with a maximum building area of 70 m 2
  •         for your own housing needs
  •         maximum two-storey (over 100 m2 of usable area)
  •         respecting the regulations regarding the distance of the house from the plot boundaries and other objects
  •         designed taking into account the local spatial development plan
  •         whose area of influence does not extend beyond your plot
  •         provided that access to a public road is provided

If you intend to build a house without a permit on a plot without a local development plan, you will also have to obtain a decision on development conditions from the commune. The "House without formalities" program assumes shortening the period for obtaining such a decision to 21 days.

House without a permit - step by step reporting procedure

If the planned investment meets the conditions for building a house without a permit, it is enough to report the construction to the district office or city office (applies to cities with district rights). What does this procedure look like step by step?

1) You report construction work on the appropriate form to the appropriate district office or city hall.

2) Please attach the following documents to your application:

and.        a statement that the construction is to meet your own housing needs,

b.        plot development project,

c.        architectural and construction design with opinions,

d.        a decision on development conditions if the plot is not covered by the local spatial development plan,

e.        a statement of acceptance of responsibility for managing the construction site if you do not wish to employ a construction manager or keep a construction log (you are not obliged to do so).

          3) You report the start date of construction to the appropriate construction supervision authority (e.g. via the eBudownictwo platform). Construction must start within 3 years.

          4) After receiving the notification, you may start construction immediately, as the architectural and construction administration body has no right to object in this case.
