House for registration 70 m2 – the most important rules

" House on notification 70 m2 ", or rather - " House without formalities " is one of the key projects of the Polish Deal. The solution came into force on January 3, 2022, enabling anyone who owns a building plot to build a house:

  •         in order to meet your own housing needs,
  •         detached,
  •         maximum two-storey,
  •         with a building area of up to 70 m2 (but the ground floor and first floor may have a total usable area of over 100 m2 ),
  •         whose area of influence is entirely located on a given plot,

without obtaining a decision on a building permit, but only on the basis of a notification . An application under the simplified procedure can be submitted online. In the absence of a local spatial development plan, development conditions must be issued within a maximum of 21 days. Additionally, the investor is released from the obligation to appoint a construction manager and keep a construction log, but then he or she assumes responsibility for managing the construction, which is confirmed by a written declaration. He or she is obliged to comply with the provisions of the construction law. Importantly, the architectural and construction administration body does not have the right to object (although it does have the right to inspect the investment), so construction work can begin immediately after the delivery of a complete notification - within the time specified in the notification of the construction supervision body.

A house for registration of 70 m 2 is a "full-fledged" residential building with a complete set of installations. It must be equipped with electrical, water and sewage and heating installations. If the plot on which the house is to be built does not provide access to the sewage network, the investor is obliged to install a domestic sewage treatment plant or a tank for liquid waste.

  1.           The installation of electricity, water, sewage, heating and telecommunications systems inside and outside buildings does not require a building permit or a notification.
  2.           However, the construction of a new house for a 70 m2 application requires that the application be accompanied by, among other things, an architectural and construction design, which as a standard includes all the necessary internal installations.

It is worth knowing that installing a gas system in a newly built house involves more extensive formalities. You should start by commissioning a project of the installation to a person with the appropriate qualifications. Then you need to submit an application for a building permit together with a diagram of the internal gas installation. In the case of an existing building, the application is submitted together with the project of the installation, an indicative map and the opinion of a chimney sweep. In addition, the installation work must be carried out by specialists with qualifications, and keeping a construction log is obligatory. The investor also has to accept the gas installation, preceded by a system tightness test.

Do not confuse installations with connections! Power, water, sewage, gas, heat and telecommunications connections require a building notification. However (!) the investor can use the second, simplified solution, regulated in art. 29a of the Building Law, which allows the construction of the above-mentioned connections without a notification. All that needs to be done is to make a situation plan on a copy of the current base map or unit map. The investor selects the procedure.

Is it possible to modify a ready-made house design for a 70 m2 application?

When planning to build a house for a 70 m 2 application, you can (but of course you don't have to) use one of many ready-made, complete architectural and construction designs, selected in a competition conducted by the General Office of Building Supervision. Importantly, such a design may be subject to changes and adaptations, and any modifications require appropriate building permits and a current certificate of entry on the list of the appropriate professional self-government chamber. In addition, any changes must be clearly marked or added in the form of replacement drawings.
