Added: Thursday, 5/11/2023

A lighting pole is an element of infrastructure. It provides access to light, but also increases safety. It is also worth knowing that it is often referred to as a supporting structure, which is mounted directly on the ground. A lighting fixture can be mounted on it, but the height cannot exceed 14 meters. Do I need to obtain a building permit when erecting a lighting pole, or is a notification enough?

Is a lighting pole a structure?

Polish construction law is often difficult to understand, which makes it easy to make a mistake that may result in a penalty being imposed. Therefore, you must remember to check the regulations carefully to avoid unauthorized construction, which the inspectorate may order to demolish. It is worth taking a closer look at the construction pole in the light of the law. Is a lighting pole a structure? Well, remember that the construction of specific facilities that are intended for temporary use most often requires a building permit. Construction law regarding lighting poles is slightly more complicated. You need to take into account where they are located and check whether a permit is required to erect a pole on a given facility. Remember that 6-meter-high lighting poles require a building permit. Here, Art. 28 section 1 of the Act of July 7, 1994. However, a pole with a height not exceeding 3 meters does not require a building permit. However, it must be remembered that it cannot interfere directly with the development of a given place, and the work being carried out must be reported.

Lighting pole under construction law

Lighting pole Under construction law, a lighting pole does not always require a building permit, sometimes a notification is enough. Here you must comply with Art. 29 section 1 point 22 of the construction law. If you have your own plot and want to erect a lighting pole on it, you can do it, provided that connecting the lighting does not require work that will result in disruption of the telecommunications installation in the area. A lighting pole does not constitute a structure in construction law. Remember, however, that the construction of public lighting lines must be consistent with the interpretation of the provisions contained in Art. 29 section 1 point 27. A street lighting line cannot be considered a transmission or distribution part. In this case, the pole is not used to transport energy, but is intended to ensure safety and comfort of use. It must be constructed using appropriate construction products.

How many meters should a lighting pole be erected?

In large cities, lighting poles are placed at intervals of 15 to 60 meters. The intervals must be regular. At the same time, poles must be placed along the streets to ensure uniform lighting at night. The situation is slightly different, for example, in the park. In this case, you can keep a slightly larger distance, but the important thing is the height, which cannot exceed 6 meters. However, it should not be less than 4 meters. If there is a walking or bicycle path in the park, lighting posts must also be used to mark it and ensure maximum safety. Also pay attention to the height. This supporting structure must be embedded in the ground with foundations, and the fixture cannot be mounted at a height higher than 7 meters, which is counted from the fixture's suspension. There is also a question: does the parking lot need to be lit? The regulation of the Minister of Transport and Maritime Economy of March 2, 1999 applies here, which clearly states that the parking lot must be well lit. The situation is similar in the case of a sidewalk, which is part of pedestrian traffic, so the posts are intended to ensure proper visibility on pedestrian paths.

Can you put a lighting pole on your own plot?

Of course it is possible and does not require any permission. However, the law allows for some exceptions. If, for example, an energy company wants to build a pole on your plot, you do not have to agree, but you can also conclude an agreement regarding a transmission easement. It is worth installing a pole below 6 meters because it does not require a building permit. A good choice may be the CN5/2.5/60/F160 Elmonter lighting pole . It is resistant to loads and stable. It is mounted on a foundation with a spacing of 160 mm. Another model that will provide effective lighting is the CN6/2.5/60/F160 Elmonter lighting pole .
