In 2022, one of the key projects of the Polish Deal came into effect – “House without formalities”. It enabled the construction of a two-storey single-family house with a building area of up to 70 m2 without obtaining a building permit, but only on the basis of a notification. In practice, a house of 100 m2 can be built without a permit, because the ground floor and the first floor of the building can offer a total of over 100 m2 of usable area! What is the deal with building a house without a permit?
For 3 years, the construction of a single-family house with a building area of up to 70 m2 has been possible based on a notification. The regulations of the "House without formalities" program reduce formalities to a minimum. Thanks to this, anyone, bypassing the highly formalized process of applying for a building permit, can start building a small, two-story single-family house for their own residential needs. Additionally, the investor is released from the obligation to appoint a construction manager and keep a construction log. As a result, the investor's wallet remains up to several thousand zlotys more, and construction can begin immediately after submitting the notification.
Regulations governing the performance of home installations without a permit
A two-storey, 70-metre house that you can build without a building permit today is in practice a “full-fledged” residential building with a usable area that can exceed 100 m2. There are no separate, special regulations governing the rules for performing installations in houses built without a building permit. The Act of 7 July 1994 – Building Law – applies here. It is worth knowing that on 28 June 2015, an amendment to the Act came into force, which simplified and shortened construction procedures long before the implementation of the “House without formalities” programme. The rules for constructing installations inside an existing and new building have been simplified.
The General Office of Building Supervision, in a letter dated 1 July 2015 regarding the construction of installations inside the building, confirmed that:
"Pursuant to art. 29 sec. 1 item 27 in connection with art. 30 of the Act of 7 July 1994 - Building Law (Journal of Laws of 2013, item 1409, as amended) in the wording given by the Act of 20 February 2015 amending the Act - Building Law and certain other acts (Journal of Laws, item 443), the construction of electrical power, water, sewage, heating and telecommunications installations inside a building does not require obtaining a decision on a building permit or submitting a notification."
Overview of installations you can do at home without permission and without reporting
Without applying for a building permit or submitting a notification, you can perform the following works inside the building:
- electrical installation
- water installation
- sewerage installation
- heating installation
- telecommunications installation
The obligation to obtain a positive decision on a building permit remains valid for gas installations. The provision of Article 29, paragraph 4, point 3, letter d of the Building Law states that a building permit or a building notification is not required for the installation of installations inside and outside the building in use (except for gas installations).
It should be remembered that exemption from the requirement to obtain a building permit or submit a notification does not constitute exemption from the obligation to comply with the requirements specified in other provisions of the Act and separate provisions, e.g. regulations.
In accordance with art. 29 sec. 1 item 23 of the Building Law, electrical, water, sewage, gas, heat and telecommunications connections require a construction notification. However, the amended regulations (see art. 29a of the Building Law) have also introduced a second, simplified solution - the possibility of building the above connections without notification. The investor himself chooses the procedure. However, if he decides not to notify, he must make a situation plan on a copy of the current base map or unit map.
Note! Submitting a construction notification prevents the application of the procedure under Article 29a of the Construction Law.
Permission to perform installation in a newly built house
